EPA Exempts Industrial Plants From New GHG Rules

Law360 (February 3, 2011, 2:40 PM EST) -- The U.S. Environmental Protection Agency has exempted roughly 20 major industrial facilities from new emissions standards, giving Avenal Power Center LLC a boost in its suit over the permit for a proposed plant in California.

In a surprise turnabout Monday, the EPA’s Regina McCarthy notified Judge Richard Leon of the U.S. District Court for the District of Columbia that Avenal’s permit will be grandfathered in and exempted from complying with limits on hourly nitrogen dioxide concentrations.
