Comair Ducks Punitive Damages In Ky. Crash Suit

Law360, New York (February 3, 2011, 4:21 PM EST) -- A federal judge has ruled that the family of a 2006 plane crash victim in Kentucky cannot seek punitive damages against Comair Inc., reversing two previous rulings that had instructed juries to consider awards beyond compensatory damages.

Judge Karl S. Forester granted Comair's motion for summary judgment on the issue of punitive damages Wednesday in the U.S. District Court for the Eastern District of Kentucky, saying that plaintiffs Lauren and Mattie-Kay Hebert, daughters of passenger Bryan Woodward, did not sufficiently establish that Comair was grossly negligent...
