Judge Pushes To Nix 215 Plaintiffs In Neurontin MDL

Law360, New York (February 7, 2011, 6:06 PM EST) -- A magistrate judge has recommended tossing three cases encompassing 215 plaintiffs in multidistrict litigation accusing Pfizer Inc. and Warner-Lambert Co. LLC of marketing epilepsy drug Neurontin off-label, to punish an attorney for disobeying court orders.

Magistrate Judge Leo Sorokin of the U.S. District Court for the District of Massachusetts recommended Friday that the district court dismiss three actions brought by attorney Levi Boone on behalf of the 215 plaintiffs as a sanction for Boone's alleged failure to produce required discovery.
