Whirlpool Fails To Stay LG Fridge Patent Suit

Law360, New York (February 7, 2011, 7:16 PM EST) -- A federal judge has refused to stay LG Electronics Inc.’s infringement action against Whirlpool Corp. pending the re-examination of four refrigerator patents that Whirlpool says the U.S. Patent and Trademark Office has all but rejected.

On Friday, Judge Garrett E. Brown Jr. of the U.S. District Court for the District of New Jersey favored LG's arguments and decided to plow ahead with the court action given the prospect of a protracted inter partes re-examination of the four patents at the USPTO.
