Waiver Knocked Down In Seagate Age Bias Action

Law360 (February 9, 2011, 3:58 PM EST) -- A federal judge has ruled that a waiver signed by former Seagate Technology LLC employees as part of a retirement incentive plan was invalid and did not preclude them from participating in a putative age discrimination class action.

Judge Michael J. Davis on Tuesday granted the plaintiffs' motion for summary judgment in the U.S. District Court for the District of Minnesota, saying employees who took part in Seagate's special incentive retirement plan did not, despite their signatures, waive their right to sue the hard drive maker....
