Dollar General Can't Dodge Managers' OT Action

Law360, New York (February 14, 2011, 12:14 PM EST) -- A federal judge has rejected an attempt by Dollar General operators DG Retail LLC and Dolgen Midwest LLC to throw out a class action alleging the discount store chain maintained a policy of denying managers overtime pay.

Judge L. Scott Coogler of the U.S. District Court for the Northern District of Alabama on Friday shot down the defendants’ motion to dismiss the case, saying an anticipated motion to decertify the class, if granted, would render the dismissal bid moot.
