US Airways Escapes Skycaps Action Over Tips

Law360, New York (February 14, 2011, 3:31 PM EST) -- A federal judge has thrown out a putative class action that accused US Airways Inc. of driving down skycaps' tips by imposing a mandatory $2 per bag fee on travelers.

The skycaps, who work directly for Independent Skycap Services LLC, failed to plead that US Airways was also their employer, Judge David K. Duncan of the U.S. District Court for the District of Arizona said in an order issued Friday. The order dismissed the suit but gave the plaintiffs 21 days to tweak their claims....
