7th Circ. Decertifies State Farm Roof Damage Class

Law360, New York (February 14, 2011, 5:13 PM EST) -- The Seventh Circuit on Monday decertified a class of State Farm Fire and Casualty Co. policyholders who said the insurer acted in bad faith by refusing to honor their household hail damage claims.

The lower court judge made a mistake when he certified a class of policyholders entitled to have their roofs reinspected, a three-judge panel of the U.S. Court of Appeals for the Seventh Circuit said.

Damages — not injunctive relief — are the proper remedy for a breached insurance policy, the panel said....
