Chinese Co. Wins Remand In Magnesium Dumping Suit

Law360, New York (February 14, 2011, 6:19 PM EST) -- A federal judge has ruled that the U.S. Department of Commerce improperly slammed Tianjin Magnesium International Co. Ltd. with a 111 percent anti-dumping duty on pure magnesium imports, remanding the case back to the department for further review.

Judge Jane A. Restani of the U.S. Court of International Trade issued the ruling Friday, saying the department incorrectly assigned Tianjin a higher rate when it determined an unaffiliated supplier did not cooperate in an administrative review of an anti-dumping duty order regarding Chinese magnesium imports.
