US Wins Dismissal In Enviro Contractor Payment Suit

Law360 (February 14, 2011, 3:45 PM EST) -- A federal judge has thrown out an environmental contractor’s suit alleging the U.S. government denied it payment for completed work and improperly killed its contracts, ruling that the contractor missed a deadline for submitting claims for payment.

Judge Emily Hewitt of the U.S. Court of Federal Claims on Friday ruled that remaining allegations in Environmental Safety Consultants Inc.’s complaint couldn’t survive the government’s dismissal bid because they involved claims submitted to a contracting officer that were time-barred under the Contract Disputes Act.
