ResCare Hit With Class Action Over Background Checks

Law360, New York (February 14, 2011, 6:18 PM EST) -- ResCare Inc.'s background check process "grossly and inaccurately maligned" an employment applicant by reporting a 20-year-old expunged offense and not telling him, the man claimed Monday in a proposed class action against the job training company.

Kevin W. Ross's complaint, lodged in the U.S. District Court for the Western District of Kentucky, claims the company's conduct violates the Fair Credit Reporting Act and seeks punitive damages.
