Oakland Port Facility Can't Shake CWA Suit

Law360, New York (February 15, 2011, 1:41 PM EST) -- A federal judge has refused to dismiss a Clean Water Act suit against Oakland Maritime Support Services Inc. and its president, saying the truck service facility was properly notified of alleged illegal discharges before it was sued.

Judge Claudia Wilken of the U.S. District Court for the Northern District of California ruled Monday that two letters sent by the plaintiffs — two environmental groups and a union — gave OMSS enough opportunity to find and correct the alleged discharges into the San Francisco Bay.
