State Fines NYC $2.6M Over Muddy Water Discharge

Law360, New York (February 17, 2011, 7:05 PM EST) -- The New York State Department of Environmental Conservation is seeking $2.6 million in fines from New York City for the unauthorized release of 69 billion gallons of muddy water into a Catskills creek.

The agency filed an administrative complaint on Tuesday, saying New York City and its Department of Environmental Protection did not have the authorization to divert turbid water from the Ashokan Reservoir to the Lower Esopus Creek.
