Chartis Fights Coverage For Lubrizol Superfund Site

Law360, New York (February 22, 2011, 1:53 PM EST) -- Chartis Specialty Insurance Co. has filed a suit seeking declaratory judgment that it does not owe specialty chemical maker Lubrizol Corp. coverage over cleanup costs at a Texas Superfund site.

In a complaint lodged Friday in the U.S. District Court for the Northern District of Ohio, Chartis says that a Lubrizol plant near Deer Park, Texas, was never supposed to be covered under certain parts of a policy between the companies, and that the pollution at issue falls outside of the policy's provisions.
