UK Court Revives Delta-Virgin Seat Patent Suit

Law360, New York (February 23, 2011, 6:47 PM EST) -- A U.K. appeals court on Wednesday ruled that a patent dispute between Virgin Atlantic Airways Ltd. and Delta Air Lines Inc. over a design for sleeper airplane seats should head to trial.

The Court of Appeal, Civil Division, said that Justice Richard Arnold of the High Court of Justice, Chancery Division, erred in ruling that Virgin's patent did not apply in its case against Delta because the allegedly infringing seats were assembled abroad, rather than on the plane itself.
