Union Carbide Gets Partial Win In Insurance Suit

Law360, New York (February 23, 2011, 8:02 PM EST) -- New York's highest court has partially granted Union Carbide Corp.'s attempt to revive its summary judgment bid in a dispute over the limits of an excess liability insurance policy covering asbestos claims made against the company.

A two-month extension of coverage by one of the insurer defendants did not trigger a new limit for the policy, the New York State Court of Appeals ruled Tuesday.

Union Carbide was correct, though, in arguing that the policy's aggregate limit was renewed annually, not continued over the three-year life...
