8th Circ. Kills Medicare Paybacks For 2 Hospitals

Law360, New York (February 25, 2011, 6:06 PM EST) -- The Eight Circuit on Friday reversed a lower court's decision granting two hospitals Medicare reimbursement for expenses they paid to train medical residents, ruling that their lack of a cost-identifying written agreement was enough to nix repayment.

A three-judge panel in the U.S. Court of Appeals for the Eight Circuit reversed a December 2009 ruling from the U.S. District Court for the District of North Dakota that granted summary judgment to Medcenter One Health Systems and St. Alexius Medical Center.
