High Court Hears Home Care Worker's Wage Case

Law360, New York (April 17, 2007, 12:00 AM EDT) -- A case that pits a 73-year-old home health care worker against a longstanding federal labor regulation exempting her from overtime compensation has the U.S. Supreme Court apparently split.

If Evelyn Coke wins her battle for 20 years of unpaid overtime wages, millions of sick people who rely on home health care workers could be forced into institutions, said Justice Stephen Breyer during oral argument in Washington, D.C. on Monday.

On the other hand, surely Congress intended that home care workers would be protected under the overtime...
