Asahi Bid To Review Ball Bearing Duties Falls Short

Law360, New York (March 2, 2011, 10:14 PM EST) -- Japanese manufacturer and exporter Asahi Seiko Co. Ltd. on Tuesday lost its challenge against the U.S. government for not selecting the company as a mandatory respondent in an administrative review of anti-dumping duty orders related to ball bearings.

Judge Timothy Stanceu of the U.S. Court of International Trade shot down Asahi’s motion for judgment on the agency record and found in favor of the U.S. Department of Commerce, holding that the company failed to exhaust its administrative remedies.
