Online Sales Bans Anti-Competitive, EU Adviser Says

Law360, New York (March 3, 2011, 7:10 PM EST) -- A French cosmetics company's refusal to let its distributors sell its products online likely violates European Union antitrust law, an adviser to the bloc's highest court said Thursday.

In a nonbinding opinion, Advocate General Jan Mazak urged the European Court of Justice to rule that general and absolute bans on selling certain goods on the Internet are designed to limit competition and do not qualify for the EU's block exemption on vertical agreements.
