TI Says Gov't Should Pay $2M Superfund Tort Costs

Law360, New York (March 4, 2011, 6:25 PM EST) -- Texas Instruments Inc. asked the U.S. Court of Federal Claims on Thursday to disregard the government’s request to toss its $2 million indemnity suit over underlying torts at a Massachusetts Superfund site, arguing the U.S. had contractual and statutory obligations to foot the bill.

Not only is the company covered through nuclear metals contracts its predecessor signed with a federal agency in the 1950s, but the Price Anderson Act ensures indemnity for the asserted claims, TI told the court in a brief opposing the government’s dismissal...
