Cephalon Bid For Apotex Docs Denied In Provigil Suit

Law360, New York (March 4, 2011, 7:54 PM EST) -- A Pennsylvania federal judge ruled Friday that Cephalon Inc. was not entitled to data on Apotex Inc.'s manufacturing practices in an antitrust suit accusing Cephalon of conspiring to keep generic versions of its narcolepsy drug Provigil off the market.

Judge Mitchell S. Goldberg of the U.S. District Court for the Eastern District of Pennsylvania ruled Cephalon's argument that it was entitled to the documents "is based on a litany of 'what-ifs,' hypotheticals, assumptions and speculation related to the past, present and future business of Apotex."...
