Scholastic Wants US To Redo Markup On China Pencils

Law360, New York (March 7, 2011, 6:27 PM EST) -- U.S. Customs and Border Protection improperly reliquidated a shipment of Chinese cased pencils purchased by Scholastic Inc. at a China-wide rate of 114.9 percent, the New York-based education publishing company claimed Friday in a lawsuit against the government.

The plaintiff and its Scholastic Book Fairs Inc. unit claim in their U.S. Court of International Trade suit that the correct markup should have been a 2.66 percent customer-specific rate instead of the higher China-wide duty.
