High Court Won’t Hear ERISA Whistleblower Case

Law360, New York (March 7, 2011, 1:11 PM EST) -- The U.S. Supreme Court on Monday declined to hear a case tossed by the Third Circuit dealing with how broadly the Employee Retirement Income Security Act’s whistleblower provisions should apply.

The petitioner in the case had argued that the high court needed to sort out a circuit split on the issue that was threatening to undermine the statute itself.
