Wine Sellers Fail To Get Cert In Texas Shipping Case

Law360 (March 7, 2011, 6:23 PM EST) -- The U.S. Supreme Court on Monday declined to hear a case challenging a Texas law upheld by the Fifth Circuit that allows alcohol stores in the state to ship wine directly to state residents, but prohibits out-of-state companies from doing the same.

After considering it at three different conferences, the justices denied a petition for writ of certiorari by a group of wine retailers, including Wine Country Gift Baskets.com, who maintain the law discriminates against out-of-state retailers in violation of the commerce clause of the U.S....
