NLRB Failed To Prove Power Co. In Contempt: Court

Law360, New York (April 19, 2007, 12:00 AM EDT) -- An appellate court has ruled that the National Labor Relations Board failed to prove that Georgia Power Co. was in contempt of an earlier decision ordering the company to engage in collective bargaining with employees represented by a local electrical worker union.

The U.S. Court of Appeals for the Eleventh Circuit on Thursday held that NLRB failed to establish by clear and convincing evidence that Georgia Power’s actions were based on an unreasonable interpretation of an earlier judgment handed down in an unfair labor practice case....
