Ex-ABB Manager Wants FCPA Charges Tossed

Law360, New York (March 8, 2011, 7:26 PM EST) -- A former general manager at an ABB Inc. unit asked a Texas federal judge Monday to throw out Foreign Corrupt Practices Act charges, arguing the Mexican officials he allegedly targeted in a bribery scheme to win utility contracts are not considered foreign officials under the law.

John Joseph O'Shea filed his motion in the U.S. District Court for the Southern District of Texas, urging the court to dismiss all but one of 18 counts in an indictment filed against him in 2009.
