Judge Dismisses Iowa Concrete Antitrust Suit

Law360, New York (March 8, 2011, 6:03 PM EST) -- A federal judge in Iowa dismissed an antitrust class action Tuesday against five of the state’s ready-mix concrete manufacturers, including four whose executives already pled guilty to price-fixing and bid-rigging in parallel criminal proceedings.

While the executives’ plea agreements are proof of several distinct antitrust agreements, the plaintiffs failed to prove a broadly ranging, four-year conspiracy across the state, according to the order dismissing the case without prejudice by Judge Mark W. Bennett of the U.S. District Court for the Northern District of Iowa.
