NY Judge Stays Ex-BDO CEO's Arbitration

Law360, New York (March 9, 2011, 8:26 PM EST) -- A New York state judge halted an arbitration Wednesday brought by former BDO Seidman LLP CEO Denis M. Field, who is on trial for tax evasion, over BDO's alleged deduction of defense costs in violation of a settlement agreement.

A carve-out provision in an arbitration clause "unambiguously" relates to $1.2 million in legal fees BDO paid Field in 2008 and 2009, according to Judge Barbara R. Kapnick of the Supreme Court of the State of New York, County of New York.
