Congress Revives Bill To Curb 'Meritless' Lawsuits

Law360, New York (March 10, 2011, 12:47 PM EST) -- A bill reintroduced Wednesday in the U.S. House of Representatives and the Senate would attempt to crack down on frivolous lawsuits by restoring a rule repealed in 1993 that dictates mandatory sanctions for attorneys filing meritless claims.

The Lawsuit Reduction Act — S. 533 in the Senate, and H.R. 966 in the House — is designed to make attorneys “think twice” before bringing frivolous suits by putting the teeth back into penalties for violations of Rule 11 of the Federal Rules of Civil Procedure, which is...
