Family Dollar Can't Shake OT Class Action Claims

Law360, New York (March 11, 2011, 11:07 PM EST) -- A Kentucky federal judge declined Friday to throw out part of an overtime class action brought against Family Dollar Inc. by a group of managers, saying he needs a better understanding of the case before he can make a decision.

The disputed part of the complaint presented a “close question” and it was too early to rule against the plaintiffs, Judge John G. Heyburn II of the U.S. District Court for the Western District of Kentucky said, denying Family Dollar's motion to dismiss.
