Judge Clips Copyright Claims In Ty Doll Suit

Law360, New York (March 15, 2011, 6:13 PM EDT) -- Plush toy maker Ty Inc. succeeded Monday in defeating much of a copyright and trade dress infringement suit levied against it in California by competitor Aurora World Inc., which accused Ty of copying its stuffed animals.

Judge Margaret M. Morrow of the U.S. District Court for the Central District of California granted the bulk of Ty's motion for summary judgment, throwing out Aurora's trade dress claims on all eight of the stuffed animals at issue and tossing copyright claims on six of the eight.
