Bus Co. Tries To Stop Dispatcher FLSA Action

Law360, New York (March 15, 2011, 2:35 PM EDT) -- Bus operator American Coach Lines Inc. on Monday sought to dismiss a putative collective action in Florida alleging it failed to pay its dispatchers overtime, about a year after it agreed to pay about $200,000 to end a similar suit.

The company filed its motion to dismiss in the U.S. District Court for the Middle District of Florida, saying the allegations of the plaintiff, David Xenias, were too vague to meet federal pleading standards.
