Calif. Utility Wants High Court Review Of FERC Plan

Law360, New York (March 16, 2011, 6:30 PM EDT) -- California's Turlock Irrigation District wants the U.S. Supreme Court to review a lower court's ruling in a case over the Federal Energy Regulatory Commission's authority to approve a state agency's plan to combine two utility districts.

At issue is whether FERC exceeded its statutory jurisdiction under the Federal Power Act when it approved the California Independent System Operator's imposition of a price for wholesale sales of electric energy made by a municipal utility, according to a petition for a writ of certiorari filed March 10....
