Suit Over Gay Spouse Benefits Tossed In Calif.

Law360 (March 17, 2011, 7:15 PM EDT) -- A California judge dismissed a suit over health benefits for the same-sex spouse of a federal employee Wednesday, saying the court could not overturn an agency's interpretation of the Defense of Marriage Act without a direct challenge to the act's constitutionality.
