Orchid Can't Nix Roche Boniva Patent

Law360, New York (March 18, 2011, 3:29 PM EDT) -- A federal judge in New Jersey Thursday rejected Orchid Chemicals & Pharmaceuticals Ltd.’s bid to toss one of the five Boniva patents Hoffmann-La Roche Inc. asserted to prevent Orchid from marketing a generic version of the osteoporosis treatment.

Judge Stanley R. Chesler of the U.S. District Court for the District of New Jersey cut down Orchid’s attempt to thin the portfolio of patents it faces in Roche’s consolidated infringement actions, finding that a terminal disclaimer linking two patents is not fatal.
