FDNY Could Face Discrimination Suit

Law360, New York (April 25, 2007, 12:00 AM EDT) -- The U.S. Department of Justice has concluded that the New York City Fire Department’s written exam discriminates against black and Hispanic applicants, leaving open the possibility of a lawsuit.

No civil litigation has been brought yet, but Cynthia Magnuson, a spokeswoman for the DOJ, said the agency has the right to sue after a 30-day waiting period.

Magnuson confirmed that the DOJ sent a letter to New York City’s government, but she declined to release the letter, saying it was against the agency’s policy.
