Court To Revisit UPS Case Over Deaf Workers

Law360, New York (April 25, 2007, 12:00 AM EDT) -- A federal appeals court has agreed to take another look at whether United Parcel Service Inc. violated the Americans with Disabilities Act by excluding the deaf from truck driver positions.

Last October, a three-judge panel of the U.S. Court of Appeals for the Ninth Circuit found that all candidates must be judged individually, and that a person’s lack of hearing does not necessarily make him or her more dangerous on the road.
