8th Circ. Exterminates Class Action Against Terminix

Law360, New York (March 24, 2011, 6:58 PM EDT) -- The Eighth Circuit on Thursday affirmed the dismissal of a putative class action accusing Terminix Inc. of cheating Arkansas consumers out of termite extermination services.

The lead plaintiff, Charles Summerhill, did not show the damage in question, all of which took place before 1996, was exempt from the statute of limitations, a three-judge panel of the U.S. Court of Appeals for the Eighth Circuit said.

Summerhill's suit, filed in August 2008, claimed that Terminix violated an Arkansas law when it failed to completely encircle clients' houses...
