5th Circ. Says WQIS Must Pay $2M For La. Barge Spill

Law360 (March 28, 2011, 7:16 PM EDT) -- The Fifth Circuit on Friday upheld a decision forcing Water Quality Insurance Syndicate to pay more than $1.8 million in defense and settlement costs following a 2001 barge accident in Louisiana that released a gaseous mixture of propane and propylene.

A three-judge panel with the U.S. Court of Appeals for the Fifth Circuit affirmed a summary judgment ruling in favor of National Union Fire Insurance Co. of Louisiana, which had paid those costs on behalf of tug and barge companies involved in the accident after WQIS...
