Paint Price-Fixing Suit Against DuPont Survives

Law360 (March 29, 2011, 7:59 PM EDT) -- A Maryland federal judge refused on Tuesday to toss a class action against DuPont Co. and other chemical companies that allegedly rigged prices on titanium dioxide.

The plaintiffs made a plausible, if not probable, case that the plaintiffs fixed prices on titanium dioxide, a paint ingredient, Judge Richard D. Bennett of the U.S. District Court for the District of Maryland said Friday.

His order allows the plaintiffs to proceed to discovery to try to prove a case against the four defendants.
