9th Circ. Affirms EPA's Calif. Auto Emissions Ruling

Law360, New York (March 30, 2011, 5:33 PM EDT) -- The Ninth Circuit on Wednesday rejected a petition from environmental groups challenging an adequacy finding by the U.S. Environmental Protection Agency on motor vehicle emissions limits for particulate matter in California.

A three-judge panel of the U.S. Court of Appeals for the Ninth Circuit found that the EPA did not violate the so-called conformity rule concerning motor vehicle emissions budgets and state transportation projects or breach the implementation rules for the particulate matter at issue, PM2.5.
