Tyson Workers Win Class Cert. In Neb. Don, Doff Suit

Law360, New York (March 31, 2011, 1:36 PM EDT) -- A federal judge on Wednesday certified a class of Tyson Foods Inc. employees pursuing claims that the company failed to compensate them for time spent donning and doffing protective gear in violation of Nebraska's wage-and-hour laws.

Despite the company's objections, Judge Joseph F. Bataillon of the U.S. District Court for the District of Nebraska adopted in its entirety a magistrate judge's recommendation that a class of workers at Tyson's Madison, Neb., meat processing plant be certified.
