EMI Loses Appeal In 'Kookaburra' IP Suit

Law360, New York (March 31, 2011, 3:56 PM EDT) -- An Australian appeals court on Thursday affirmed a ruling that the 1981 hit song “Down Under" by Men at Work, released on their record label EMI Music Publishing Australia Pty Ltd., infringes a copyright on the 1930s children's song "Kookaburra Sits in the Old Gum Tree."

A three-judge panel of the Federal Court of Australia dismissed an appeal by EMI and affirmed a lower court's ruling in favor of Larrikin Music Publishing Pty Ltd., which holds the copyright on "Kookaburra" and sued EMI in 2008....
