Judge Decertifies Dollar Tree Sex Bias Suit

Law360 (April 1, 2011, 5:26 PM EDT) -- Dollar Tree Inc. won a motion on Thursday to decertify a national collective action brought by two store managers in Alabama who claim the discount retail chain pays female store managers less than their male counterparts.

Judge Abdul K. Kallon of the U.S. District Court for the Northern District of Alabama ruled that the plaintiffs were not similarly situated nationwide. He said that the case could proceed, however, as a collective action limited to the districts where the two named plaintiffs were employed.
