HIF, BizBiotech Must Face IP Claims In Federal Court

Law360 (April 1, 2011, 2:54 PM EDT) -- A California federal judge on Thursday left intact allegations from Carlsbad Technology Inc. that HIF Bio Inc. and BizBiotech Co. Ltd. swiped inventorship rights to the anti-cancer agent YC-1, finding that the claims were appropriately situated in federal court.

Judge Dean Pregerson of the U.S. District Court for the Central District of California denied the defendants' bid to throw out CTI's first amended complaint, which asserts U.S. Patent Number 7,166,293.

The long-running legal dispute arises from a suit filed by HIF and BizBiotech — which hold the rights to several U.S. patent applications for YC-1 — against CTI and other companies...
