Supreme Court Reopens States' Water Rights Dispute

Law360, New York (April 4, 2011, 4:39 PM EDT) -- The U.S. Supreme Court on Monday gave Kansas permission to file a petition that accuses neighboring Nebraska of violating an agreement by withdrawing more than its fair share of water from the Republican River Basin.

By granting Kansas' motion, the nation's high court reopened litigation that Kansas originally brought against Nebraska and Colorado in 1998 for allegedly violating a water use agreement called the Republican River Compact.

The original dispute ended in a negotiated settlement, but now Kansas alleges that Nebraska has violated the settlement decree...
