Calif. Court Revives Suit Over Drinking Water Plan

Law360, New York (April 5, 2011, 2:19 PM EDT) -- A California appeals court gave new life Monday to a suit seeking to force the state Department of Public Health to prepare and submit a safe drinking water plan to the state Legislature.

In its published opinion, a three-judge panel with the Court of Appeal of the State of California, Fifth Appellate District, disagreed with a trial court's apparent conclusion that the statutory requirement to produce the plan was suspended because of a funding cut, remanding the matter for further proceedings.
