166 Plaintiffs Tossed From Neurontin MDL

Law360, New York (April 5, 2011, 5:20 PM EDT) -- In a multidistrict litigation accusing Pfizer Inc. and Warner-Lambert Co. LLC of off-label marketing of epilepsy drug Neurontin, a Massachusetts federal judge on Tuesday dismissed 166 plaintiffs in three lawsuits brought by attorney Levi Boone, citing repeated discovery failures.

Judge Patti B. Saris of the U.S. District Court for the District of Massachusetts was acting on an earlier report and recommendation by a magistrate judge in the MDL to dismiss all the cases in which Boone was the attorney of record.
