Meat Co. FLSA Classes Should Remain Certified: Judge

Law360, New York (April 6, 2011, 2:19 PM EDT) -- A Nebraska magistrate judge on Tuesday recommended against the decertification of two classes in donning and doffing litigation brought by production line employees at Greater Omaha Packing Co. Inc.

Magistrate Judge Thomas D. Thalken of the U.S. District Court for the District of Nebraska said the plaintiffs had produced sufficient evidence to back a ruling that the classes should not be decertified as requested by the meatpacking company.

The consolidated suits, filed in 2008, allege the meat processing company has violated the Fair Labor Standards Act...
